Die Tatsache, dass die Einhaltung der „allgemein anerkannten Regeln der Technik“ vom Auftragnehmer zumindest stillschweigend als werkvertraglicher Mindeststandard geschuldet ist, bietet nur noch wenig Neuigkeitswert.

Werden die Wechselwirkungen zwischen den Ecken des „Magischen Dreiecks“ berücksichtigt und baut man kontinuierlich die Ausprägung einer jeden Ecke aus, so steht leistungsfähigem Claim Management wenig entgegen. Ein weiterer Vorteil ist es, dass durch diese Professionalisierung auch partnerschaftliche Beziehungen zwischen den Vertragsparteien nicht gestört werden, da diese Professionalisierung einhergeht mit einer Verschiebung der emotionalen Komponente eines Claim-Konfliktes hin zum faktischen, sachgetriebenen Vorgehen in der Bewältigung gestörter Projektverläufe.

Nachforderungsmanagement (engl. Claim Management) ist gemäß DIN 69905 die "Überwachung und Beurteilung von Abweichungen bzw. Änderungen und deren wirtschaftlichen Folgen zwecks Ermittlung und Durchsetzung von Ansprüchen".

Notice clauses are contained in many contracts and are important, although often overlooked, in construction contracts. These clauses require parties to contracts to notify each other in certain circumstances, to give them the chance to deal with any problems which might come up.

It is common for construction contracts to require a party to give timely notice of claims to the other. Most standard form contracts provide some mechanism to regulate the giving of such notices and the likely consequences that will arise if notices are not given as stipulated in the contract. This article analyses some of the implications that flow from the insertion of notice provisions in construction contracts, with anecdotal references to the impact of these clauses in Southeast Asia.
